128. कोई भी व्यक्ति, जो विवाहित है या जो विवाहित रह चुका है, किसी संसूचना को, जो किसी व्यक्ति द्वारा, जिससे वह विवाहित है या रह चुका है, विवाहित स्थिति के दौरान में उसे दी गई थी, प्रकट करने के लिए विवश न किया जाएगा, और न वह किसी ऐसी संसूचना को प्रकट करने के लिए अनुजात किया जाएगा, जब तक वह व्यक्ति, जिसने वह संसूचना दी है या उसका हितप्रतिनिधि सम्मत न हो, सिवाय उन वादों में, जो विवाहित व्यक्तियों के बीच हाँ, या उन कार्यवाहियों में, जिनमें एक विवाहित व्यक्ति दूसरे के विरुद्ध किए गए किसी अपराध के लिए अभियोजित है ।
Bharatiya Sakshya Act, 2023 Section 128 in English
- No person who is or has been married, shall be compelled to disclose any communication made to him during marriage by any person to whom he is or has been married; nor shall he be permitted to disclose any such communication, unless the person who made it, or his representative in interest, consents, except in suits between married persons, or proceedings in which one married person is prosecuted for any crime committed against the other.
