- जबकि प्रयुक्त भाषा भागतः विद्रद्यमान तथ्यों के एक संवर्ग को और भागतः विद्यमान तथ्यों के अन्य संवर्ग को लागू होती है, किन्तु वह पूरी की पूरी दोनों में से किसी एक को भी ठीक-ठीक लागू नहीं होती, तब यह दर्शित करने के लिए साक्ष्य दिया जा सकेगा कि वह दोनों में से किस को लागू होने के लिए अभिप्रेत थी ।
दृष्टांत
ख को “मेरी भ में स्थित म के अधिभोग में भूमि” बेचने का क करार करता है। क के पास भ में स्थित भूमि है, किन्तु वह म के कब्जे में नहीं है तथा उसके पास म के कब्जे वाली भूमि है, किन्तु वह भ में स्थित नहीं है। यह दर्शित करने वाले तथ्यों का साक्ष्य दिया जा सकेगा कि उसका अभिप्राय कौन सी भूमि बेचने का था ।

- When the language used applies partly to one set of existing facts, and partly to
another set of existing facts, but the whole of it does not apply correctly to either, evidence may be given to show to which of the two it was meant to apply.
